Terms and Conditions of Purchase

These Terms and Conditions regulate the use of the website www.juliaduran.com, of which Júlia Duran Vilar (hereinafter ‘the Company’), with CIF 48.030.996G and registered office in Calle Travessera de dalt 42, 08024 Barcelona, is the owner.

Through www.juliaduran.es, the Company provides information about its products, together with the opportunity to purchase those products.  Due to the content and purpose of the site, those persons who wish to benefit from the services it offers must have the status of ‘Customer’, a status which is obtained by completing the registration form and following the steps subsequently indicated by the Company through email.  Customer status implies adherence to the published Terms and Conditions of Purchase current at the time when the website is accessed.

In any event, there are pages on the website that are accessible to natural or legal persons who neither register nor initiate the purchase of a product, hereinafter termed ‘Users’. In this sense the Users who access these areas of the website agree to be subject to the stipulations in these Terms and Conditions, insofar as these may be applicable.

The Company hereby informs its Customers and Users that it is aimed exclusively at an audience over the age of 16, and that its products can be delivered to any national or international destination.

PRODUCTS

Our navigation menu includes the catalogue of the products offered.  Each entry includes detailed information regarding its characteristics, and the product itself can be viewed by means of images.

All orders are gift wrapped, and a case and cloth pouch are always included.

 

PRICES

The product prices indicated on the website are inclusive of 21% VAT.  However, these prices do not include delivery costs for the item. These are quoted separately and must be accepted by the Customer.

DELIVERY COSTS

We work with different shipping companies, choosing the most appropriate one based on the delivery destination to ensure effective delivery. Shipment tracking is available at all times upon customer request.   

 

SPAIN

Purchases under €100: € 4.95

Purchases over €100: free delivery.

Delivery time: up to 48 working hours from the time that the order was placed.

    

THE BALEARIC ISLANDS

Purchases under €120:  € 7.95

Purchases over €120: free delivery.

Delivery time: 4 working days from the time that the order was placed.

   

THE CANARY ISLANDS, CEUTA AND MELILLA

Purchases under €200: €25

Purchases over €200: free delivery.

Delivery time: 4 working days from the time that the order was placed.

*The Canary Islands: it is important to take into account the fact that shipments will be subject to an additional SCD import payment (only where the value of the order is mover €150), and payment of the corresponding IGIC (13.5% of the value declared on the invoice) at the time of delivery.  These, together with any other applicable customs duties will in all cases be the responsibility of the purchaser.

*It is important to take into account the fact that shipments made to Ceuta and Melilla are subject to the payment of import duties and taxes and/or local customs duties, and that these will in all cases be the responsibility of the purchaser.

 *Deliveries to countries outside the EU may incur additional levies and taxes that will in all cases be the responsibility of the purchaser.

AVAILABILITY

The Company informs the Customer that the number of items available is maintained updated using inventories and at no time will it intentionally offer for sale more units than are currently available, except where the term ‘reserve’ is explicitly used.

However, on occasion, and due to circumstances difficult to control such as human error or computer incidents, and in the case that the product is not available after the order has been placed, the Customer will be informed by email of the cancellation of all or part of her/ his order.  The cancellation of part of the order due to lack of availability does not confer the right to cancel the totality of the order. If because of this cancellation the Customer should wish to return a product once it has been delivered, s/he must follow the instructions in the ‘Returns’ section.

If the order should include any products classified as ‘reserve’, these will be delivered on or after the date specified.  Customers are also informed by email of this situation and may choose to cancel the order of such products before that date if they wish.

PAYMENT

The Customer commits to payment at the time at which the order is placed.  The corresponding delivery charge will be added to the initial price of each of the products offered.

The receipt or purchase confirmation corresponding to the order will be sent to the registered email address.

The customer must pay the amount corresponding to their order by credit or debit card (Visa, Mastercard, Visa Electron, American Express, or similar), PayPal, Google Pay or Apple Pay.

The Company incorporates the highest levels of security commercially available within the sector.  Moreover, payments are processed on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection transferring the data algorithmically coded at a speed of 128 bits, thus ensuring that it is intelligible only to the Customer’s computer, and to the website.  Using the SSL protocol guarantees that the Customer’s data is only communicated to the server centre of the payment gateway, and not to a bogus one, and that between the Customer and the payment gateway’s server centre the data is transmitted in code, so that it cannot be read or manipulated by third parties.

Verisign Inc., world leader in the issuing of SSL certificates guarantees the coding of data in PayPal.

PLACEMENT OF ORDERS

Once the order has been placed, implying acceptance of the Terms and Conditions of purchase, and the order has been confirmed, the Customer will always receive an email confirming the details of the purchase made.

CANCELLATION OF ORDERS

Requests for the cancellation of orders placed will be accepted in the case that they are made before the item(s) have been sent out of delivery.  In order to make a cancellation, the Customer must request the cancellation by using the ‘Customer Service’ form, or by sending an email to info@juliaduran.com.

DELIVERIES

Our products are delivered to the address indicated by the Customer on the order form.  In order to optimise delivery, we ask the Customer to provide an address the order can be delivered to within standard working hours.

The Company will not be responsible for errors caused when the address entered on the order form by the Customer does not conform to reality.

The order will be delivered to the Customer within the maximum time frame stipulated in the section ‘Delivery Costs’, from which the order confirmation is generated.  The time frames indicated are averages, and as such are estimated. They may vary for logistical reasons or due to force majeure. In the case of delivery delays, the Customer will be informed as soon as we are aware of these.

Each delivery is considered complete from the moment at which the transport company hands the order over to the Customer, which is recorded by means of the control system used by the transport company.

Once the order leaves our premises, you will be sent an email telling you that your order is now on its way.

For reasons of security orders will not be delivered to post office boxes.

If at the time of delivery, the Customer is absent, the shipper will leave a delivery note indicating the steps the Customer needs to take in order to arrange a new delivery time.  

 RETURNS AND EXCHANGES

All products purchased on the website www.juliaduran.com can be returned, provided that the Customer communicates her/ his intention to return them to the Company within 24 hours.  Returns must be made within 15 calendar days, counted from the day of delivery, to the address indicated by the Company.

Attention: Due to hygienic reasons, we are unable to accept any exchange or return on any earrings.

If the reason for the return is that the product is defective or it is the wrong item, the cost of the return will be repaid to the Customer.  If the return has been made for any other reason (the products arrived in good order but the Customer was not happy with them), the cost of the return will be paid by the Customer.

The return of the products will give rise to the refund of the cost of the products returned, minus the return delivery cost.

The Company will reimburse the Customer for the cost of the return delivery only in the case that the product delivered is defective or is the wrong item.

Partial returns and cancellations will give rise to partial refunds.

The payment of the refund to the Customer’s account or card will depend on the card and the issuing entity. The time frame applicable to refunds is up to 7 days for debit cards, and up to 30 days for credit cards. 

MODIFICATION OF CONDITIONS

The Company reserves the right to modify at any time the presentation and configuration of the website, and also the current Terms and Conditions.  For this reason, we recommend the Customer to read them each time s/he accesses the website. Customers and Users will always find them in a visible location where they are freely accessible for consultation.  In any event, the acceptance of the Terms and Conditions of Use is a step that must be taken before the acquisition of any product available on the website.

ANNULMENT

In the case that any clause within the current Conditions should be declared null and void, the remaining clauses will remain valid, and will be interpreted taking into account the will and purpose of the parties concerned.   

The Company may choose not to exercise any of the rights and powers conferred in this document, but this does not in any way imply the waiver of those rights and powers except in the case of express recognition on the part of the Company, or in the case that the time limit corresponding to the case has expired.

APPLICABLE LAW AND ARBITRATION

These conditions are governed by the applicable Spanish legislation.  In order to resolve any controversy or conflict that should arise from the same, the parties concerned will submit to the jurisdiction of the Barcelona courts, unless t another jurisdiction should be imposed by law.
